Why are the two terms often confused?
Many business owners use the terms "environmental permit" and "environmental license" interchangeably. However, the National Center for Environmental Compliance (NCEC) — the authority responsible for issuing both documents — clearly distinguishes between them by dividing its e-services into two separate directories: "Environmental Permit Services" and "Environmental License Services". This distinction is not merely formal: each document addresses a different party in the environmental relationship and follows a different path with different requirements.
What is an environmental permit?
According to the official page for the "Environmental Permits for Facilities" domain on the Center's website, through this domain the Center oversees "the extent to which facilities comply with the environmental laws and requirements set out in the Environment Law and its implementing regulations", by supervising the issuance of environmental permits and licenses, reviewing violation reports and setting annual inspection plans. In practice, an environmental permit is the document the establishment itself needs before constructing, operating, modifying, expanding or closing any activity with an environmental impact. When the "Implementing Regulation for Environmental Permits for the Construction and Operation of Activities" came into effect (based on Article 48 of the Environment Law issued by Royal Decree No. M/165 dated 19/11/1441 AH), the Ministry of Environment, Water and Agriculture confirmed in an official news release that its provisions apply to "all persons who own or operate any activity with an environmental impact... including construction, operation, modification, addition, expansion and closure". The release also explained that the regulation classifies activities into three categories according to their environmental impact, which determine whether an Environmental Impact Assessment is needed.
What is an environmental license?
An environmental license, by contrast, is mainly aimed at environmental service providers themselves, not at the establishment that owns the activity. According to the official page for the "Environmental Licensing for Environmental Service Providers" domain, the Center's Licensing Department is responsible for "issuing licenses to environmental service providers, and setting and defining the licensing requirements and guidelines for environmental service providers by activity", in addition to evaluating and monitoring these entities' performance and updating their licensing regulations. An example of this type in the e-services directory is the "Environmental license service in the field of environmental studies and consulting", aimed at entities that prepare Environmental Impact Assessments and environmental plans for other establishments. The Center's main website also lists among its e-services: "licensing and accreditation services for entities working in environmental services related to the Center's activity and scope of work".
Quick comparison
- Who it addresses: environmental permit — the establishment that owns the activity with an environmental impact; environmental license — an environmental service provider (consultant, laboratory, studies firm...)
- Purpose: environmental permit — permission to construct/operate/modify/expand/close an activity; environmental license — permission for the service provider to practise a specific environmental activity as a profession
- Issuing authority: environmental permit — the National Center for Environmental Compliance (NCEC); environmental license — the National Center for Environmental Compliance (NCEC), through its Licensing Department
- Channel: environmental permit — the electronic permits and licenses platform; environmental license — the electronic permits and licenses platform
Why does this difference matter to your establishment?
Knowing the difference prevents an establishment from applying for the wrong service or contracting an unlicensed entity to prepare its environmental studies. If your establishment carries out an activity with an environmental impact, you need an environmental permit; if you provide environmental services to other establishments (studies, consulting, waste treatment...), you need an environmental license for yourself as a service provider. In both cases, establishments need to make sure that any service provider they contract (to prepare an Environmental Management Plan or an Environmental Impact Assessment, for example) holds a valid license from the Center.
How Beati helps
Beati provides a database of qualified environmental service providers to support establishments with their various needs, from activity classification to preparing environmental studies and plans. This helps your establishment make sure it is dealing with the right party for the type of document required (permit or license), and connects it with the related environmental compliance and waste collection services.
Frequently asked questions
Could my establishment need both an environmental permit and an environmental license at the same time?
In principle, yes. If the establishment carries out an activity with an environmental impact and also provides environmental services to other parties, it may need both documents, each according to the role it plays, based on the Center's division between the permits and licensing domains.
Which authority issues environmental permits and licenses in Saudi Arabia?
The National Center for Environmental Compliance (NCEC) is the authority responsible for overseeing the issuance of both types of document through its electronic platform.
Does the Implementing Regulation for Environmental Permits cover modifying or expanding an activity?
Yes. The Ministry of Environment, Water and Agriculture confirmed that the provisions of the Implementing Regulation for Environmental Permits cover the construction, operation, modification, addition, expansion and closure of any activity with an environmental impact.
